Evolutionary Skin LLC Service Agreement

PLEASE READ THROUGHLY BEFORE YOUR APPOINTMENT.

This Service Agreement ("Agreement") is made and entered into as of the date of signature below by and between Evolutionary Skin LLC, a limited liability company organized and existing under the laws of the State of California, with its principal place of business at 19231 Victory Blvd.exclamation Suite 554, Tarzana, CA ("Evolutionary Skin"), and the undersigned client ("Client").

Services

Evolutionary Skin agrees to provide the Client with the spa and skincare services selected by the Client, subject to the terms and conditions of this Agreement.

Informed Consent

Client hereby gives informed consent to receive facial treatments and other services from Evolutionary Skin. Client understands and acknowledges that there are inherent risks and potential complications associated with any facial treatment or skincare service. Client confirms that they have had the opportunity to ask questions and have received satisfactory answers to those questions.

Assumption of Risk & Liability Waiver

Client acknowledges and understands that there are inherent risks and potential complications associated with facial treatments and skincare services, including but not limited to allergic reactions, skin irritation, and other unforeseen reactions. Client voluntarily assumes all risks associated with these services and hereby releases and forever discharges Evolutionary Skin LLC and its members, managers, employees, agents, and representatives from any and all liability, claims, demands, actions, or causes of action arising out of or in connection with the services provided, except in cases of gross negligence or willful misconduct.

Payment Terms

Payment Methods: Evolutionary Skin accepts credit and debit cards, cash, Cash App, Zelle, Venmo, Klarna, Affirm, and Afterpay. A 3% convenience fee applies to credit/debit/buy now pay later transactions.

Packages and Memberships:

Packages:

Payment plans of up to four installments are available through buy now pay later services.

Packages MUST be paid in full prior to starting treatment.

Packages cannot be canceled for a refund once started.

Each package has a strict timeline for use. Book your sessions in advance to avoid any loss or expiration of service.

Memberships:

Enjoy a $50 discount on tiered services (renew, refresh, rebuild).

Receive 15% off all product purchases and add-ons.

Unused membership packages can be rolled over as credit, or gifted, but may not be refunded. The credit expires after one year.

Membership cancellation requires 30 days' notice, otherwise, the next payment will process and the following cycle will be canceled.

Cancellation/No-Show Policy

24-Hour Notice: A 24-hour cancellation notice is required for all appointments.

Fees: Late cancellations and no-shows will incur a fee equal to 50% of the (pre-discount) appointment cost. After one incident, future appointments will require a deposit.

Service Changes: If a Client downgrades or cancels a service during an appointment, it is considered a cancellation and a 50% fee will apply.

Gift Cards

Validity: Gift cards are valid for services only and cannot be exchanged for cash.

Expiration: Gift cards expire one year after the date of purchase.

Late Arrivals

Clients arriving more than 15 minutes late may be treated as a no-show and rescheduled with a cancellation fee.

Refunds

All sales are final. Refunds will not be issued for services or products.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of California.

Entire Agreement

This Agreement constitutes the entire agreement between the parties and supersedes all prior or contemporaneous communications and proposals, whether oral or written.

Modification

This Agreement may not be modified except in writing and signed by both parties.
